As one who is not very familiar with the law, I’m hoping someone here might be able to help me shed light on this subject.
So, my friend – we’ll call him Jeff – got married in December after a very short courtship with a woman he met online. We’ll call her Miss Herpes. Both are middle aged, secure in their lives and not the wild younguns they used to be – and, as far as Jeff knew, both came clean about their pasts before the marriage. Well, January rolls around and Jeff gets very sick. He goes to the doctor, and none of the usual suspects are guilty of causing his sickness. The doc suggests it might be an STD, Jeff thinks it’s crazy but gives in to a test.
Later that day, before Jeff gets his results, he goes home and tells his new wife what the doctor said. “What’s so crazy about that?” She asks. “Is there something you need to tell me?” He says. One thing leads to another, and it turns out she has herpes. “How did you not have it?” She asks, “Everyone I’ve ever been with has had it.”
Jeff is devastated. After years of sexual precautions, the woman who is supposed to be able to trust more than anyone else gives him herpes with no apology.
Jeff lives in Texas. Legally, where does he stand? What can he do? Is there any hope for the poor guy?

I think he stands a very good chance of being able to sue the bitch for every dime she has.
That won’t help him. He has this and it isn’t going to go away.
That has got to suck. He is careful for decades, and this woman does him in.
Fortunately he has been married a very short period of time and may be able to get it legally annulled without a divorce, alimony, etc
Need I say…that you can’t trust AW?

Well, had something similar to this. Found a bottle of Valtrex in womans medicine cabinet….”ohh it’s nothing, its for my nose” whatever honey…peace. As far as the law, the only one I know of is the HIV law and thats not even in all states. Which is to willfully give someone HIV. I once read 1 outta 4 woman has Herpes in this country. If thats true, thats fucking sad.

Thanks for the feedback. I truly appreciate it.
I’ve been doing the research, but I can’t seem to find if its possible to transmit the virus by touching, toilets, baths, etc. I’d would like to know because I frequently visit this man for a weekend about once a month.

Texas is fairly man-friendly in divorces (at least relatively speaking). He could also seek an annulment, probably able to claim fraud if she did indeed ‘come clean’ and yet forget to mention this.

I have another friend – a woman, to reverse genders – who contracted herpes from her then-husband who never told her either.
I am disease-free and intend to stay that way if it means abstinence. Too many AW are infected with an STD, those are the consequences of adultery, promiscuity, and fornication.

but unless you both go to the clinic to get tested before you go even think about having any sexual contact whatsoever (you can get herpes from oral sex just as easily as from intercourse), and you both get validated to be disease free, then you are taking some big chances in today’s world.
All the more reason to be monogamous and get married. Unfortunately, marriage has its obvious drawbacks as well.
Pretty soon, sex will be like it was in that futuristic Los Angeles in Demolition Man where men and women don’t even touch when they have sex.

tg, celibateforlife, I agree! Its a shame that Planned Parenthood has painted abstinence as a choice that only a Protestant Christian can choose, thus effectively barring it from public schools.
I’m “pro-choice”, choose NOT to have sex.
I don’t like going into details about things like this, but I need to say anonymous, I believe you’re wrong about one thing, its my understanding that even a cold sore can turn into genital herpes. So its actually EASIER to transmit it in that way, which again, is something that PP (heh, fitting initials) probably won’t be telling any of our nation’s children.

The only difference between a cold sore and genital herpes is location. You can get herpes anywhere on your body. The virus is of the same family, and is often the same.
You can even get genital herpes strain on your face.

Cold sores can indeed become genital herpes through oral sex, but only during an outbreak. The same is true for genital herpes. Both of these problems are nuisances but don’t need to destroy one’s love life. About 40% of the population has oral herpes -AKA cold sores. Do you want to ban the entire country? Get real. You guys are being a bunch of paranoid knuckleheads.

A note on oral herpes: whilst cold sores (blisters typically appearing on the lips) are caused by the herpes simplex virus, canker sores (ulcers typically appearing inside the lips or on the gums) are not. The latter usually arise in response to a minor gum injury and can be aggravated by stress.

I did a double take when I read this teaser on the cover of the March 2004 Latina magazine.
I’d heard of born-again virgins, but I seriously doubted anyone could actually ever get their virginity back. I mean, once it’s gone, it’s gone — right?
Well, sort of.
There is a procedure, called hymenoplasty, which reconstructs the hymen.
So, virginity can be superficially restored. In other words, as far as the guy can tell, he’s the first.
According to the article, titled “The Immaculate Deception,” the highest demand for the procedure are among Korean, Middle Eastern and Latina women.
The hymen is the “thin membrane that partly seals off the opening to the vagina until it is ruptured, typically during a first act of sexual intercourse,” the article says.
According to labiadoctor.com, “The hymenal ring normally gets disrupted after a woman has had sexual intercourse or even after strenuous physical activity or tampon use.”
In a PowerPoint presentation on obgyn.net, a medical site for women’s health professionals, Dr. Mohammed El-Hennawy said that the hymen can also be broken “while participating in sports like bicycling, horseback riding, gymnastics … or while masturbating. A girl may not even know this has occurred, since there may be little or no blood or pain involved when this happens.”
He continues to say that, “In some societies, the hymen must be intact in unmarried women as proof of virginity. Without it, — women are shunned as whores — in extreme cases even murdered by male relatives to restore family honour.”
El-Hennawy said in some cultures, if a woman experienced pain and bleeding on her wedding night, it was proof she was a virgin.
In Egypt, he says, “It is not unusual for a rape victim to marry her rapist to maintain at least the appearance of honor. In fact, according to Egyptian law, once a rapist marries his victim, charges against him are dropped and honor is restored to the woman and her family.”
El-Hennawy said honor killings still occur in some Arabic countries and that gynecologists often have to explain to “a whole horde of male relatives” why a woman didn’t bleed on her wedding night.
“You always have to favor the girl, because if you don’t, she’ll be killed by her family. … So you tell the male relatives the bride had an elastic hymen, which many women do anyway, and in such cases she wouldn’t bleed,” he said.
El-Hennawy said hymenoplasty “quite honestly saves lives” but it is illegal in most Arab countries.
According to labiadoctor.com, “the surgery is usually performed under local anesthesia. … After the surgery, it is recommended to avoid sex, tampons, and douching for six weeks.”
The Latina article says patients are also advised to avoid exercise for two weeks and sexual intercourse for about a month to allow for healing.
A Dominican teen who underwent the procedure said in the article, “To Hispanic parents, to have an unmarried daughter who is a virgin is something sacred.”
Before I fully read the article, I thought this procedure seemed ludicrous.
“Are we living in the Dark Ages?” I wondered.
Now, it seems that hymenoplasty itself is not the problem, but rather a symptom of the problem.
As American women, we tend to take for granted the rights we have.
Yes, we still earn less money than men and we’ve yet to see a female president.
But we’ve come a long way and, for many of us, the thought of facing death if we don’t bleed on our wedding night has never crossed our mind.
Hymenoplasty is the result of a culture that still looks at women as less than men. There are obviously double standards.
As far as I know, there is no way to tell if a man is still a virgin or not. Furthermore, it doesn’t seem to matter.
Even in America, if a woman has had several partners, she is labeled as a slut or whore, two words which contain the word “woman” in their definitions.
Promiscuous men are labeled as “players.” The difference in the implications of these words says a lot.
Women have proven they can do anything a man can do.
We’re members of Congress, doctors, lawyers, CEOs, professional athletes and more.
But in some parts of the world, women are still being persecuted for engaging in something as natural as sex. And some of these dishonored women may, in fact, still be virgins who broke their hymens by using tampons or riding a horse, or who simply weren’t born with one at all.
In the 21st century, these double standards are irrational and unacceptable, and we need to take a stand against sexist attitudes that encourage practices such as hymenoplasty.
